بزه‌دیده‌شناسی‌ حمایتی‌ در پرتو «اعلامیه‌ اصول‌ بنیادی‌ عدالت‌ برای‌ بزه‌دیدگان‌ و قربانیان‌ سوءاستفاده‌ از قدرت‌»

چکیده

اگر مطالعه‌ بزه‌دیدگان‌ نخست‌ در قالب‌ یک‌ دیدگاه‌ منفی‌نگرانه‌ با تأکید بر نقش‌ و تقصیر بزه‌دیده‌ در رویداد جنایی‌ (بزه‌) از بطن‌ جرم‌شناسی‌ سربرآورد، اکنون‌ بیش‌ از سه‌ دهه‌ است‌ که‌ همه‌ نگاه‌ها به‌ حمایت‌ از این‌ اشخاص‌ آسیب‌پذیر جهت‌ یافته‌ است‌. بدین‌ ترتیب‌، بزه‌دیده‌شناسی‌ حمایتی‌ یکی‌ از رویکردهای‌ نوین‌ جرم‌شناسی‌ است‌ که‌ رفته‌ رفته‌ به‌ کسب‌ استقلال‌ در سرزمین‌ علوم‌ جنایی‌ نزدیک‌تر می‌شود. در این‌ میان‌، بین‌المللی‌ شدن‌ این‌ رویکرد مطالعاتی‌ که‌ همسو با فرایند جهانی‌ شدن‌ سرعت‌ بیشتری‌ به‌ خود می‌گیرد آن‌ را به‌ یکی‌ از کانون‌های‌ توجه‌ در سطح‌ سیاست‌گذاری‌ بین‌المللی‌ و یکی‌ از دغدغه‌های‌ مهم‌ سیاست‌های‌ جنایی‌ تبدیل‌ کرده‌ است‌. همسو با این‌ تحول‌، سازمان‌ ملل‌ متحد پس‌ از به‌ انجام‌ رسیدن‌ پژوهش‌های‌ جرم‌شناسانه‌ بسیاری‌ از کشورها در این‌ حوزه‌، با بهره‌گیری‌ از یافته‌های‌ این‌ پژوهش‌ها تلاش‌ خود را برای‌ پی‌ریزی‌ اصول‌ و ملاک‌هایی‌ جهانی‌ برای‌ حمایت‌ از بزه‌دیدگان‌ بکار بسته‌ است‌. « اعلامیه‌ اصول‌ بنیادی‌ عدالت‌ برای‌ بزه‌دیدگان‌ و قربانیان‌ سوءاستفاده‌ از قدرت‌ » سرآمد این‌ تلاش‌ها و به‌ منزله‌ منشوری‌ دربردارنده‌ استانداردهای‌ جهانی‌ در چارچوب‌ یک‌ بزه‌دیده‌ شناسی‌ حمایتی‌ به‌ شمار می‌آید که‌ بررسی‌ مفاد آن‌ موضوع‌ این‌ مقاله‌ را تشکیل‌ می‌دهد.

Although studying crime victims primarily emerged within the framework of a negative perspective emphasizing upon blameworthy of victims in the criminal incident, it is more than three decades that attentions have been addressed to protecting these vulnerable persons. "Protective Victimology", thus, is considered as one of the most recent approach in criminological literature, which is gradually becoming an independent discipline in the field of criminal sciences. Meanwhile, it's international aspect, which followed on the globalization movement, has made it to be at the centre of attention at the policy-making level and a significant concern of criminal policies. Following victimological researches in many countries, the United Nations made special efforts to codify the international principles and standards on victim protection. The Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power is regarded as the most eminent of such efforts and assumed as a charter containing the global standards within the framework of a protective victimology. The present article reviews the Declaration overall.
