In the regulation of the procedure, the rights of third parties should be taken into account in order to allow the possibility to any person who may claim a right or interest in the dispute, in a transparent process. Multi-party cases in state courts have been identified, irrespective of the agreement of the parties concerned, but in arbitration because of free will of the parties as a main principal that governs on to the arbitration proceedings, the entry of third parties even if their interests were subject to arbitration, It was not possible without the consent of the parties, because privacy and confidentiality are the main features of arbitration and someone other than the parties to the arbitration not only could not be involved in the course of the proceedings as a party but could not even attend the hearing. This procedure was changed by adopting UNCITRAL Rules on Transparency in Treaty-based Investor-State Arbitration, and third parties were allowed not only in litigation but also as a party to the dispute, and this changed the main features of arbitration.}, keywords = {Privacy,Confidentiality,Third Party Intervention,Arbitration Law of Iran,UNCITRAL Rules,Transparency}, title_fa = {امکان ورود ثالث در داوری بر اساس سیر قواعد آنسیترال و قانون داوری تجاری بین‌المللی ایران و تأثیر آن بر خصوصی و محرمانه بودن داوری ‬‬‬‬‬‬}, abstract_fa = {با گسترش روابط اجتماعی و حقوقی میان افراد در جامعه بشری، تزاحم منافع میان آنان مطرح‌ شده و نتیجه آن در طرح دعاوی مختلف و تعدّد اطراف این دعاوی آشکار می‌گردد. در تنظیم مقررات آیین دادرسی باید به حقوق اشخاص ثالث توجه شود تا امکان طرح دعوی از سوی هر شخصی که ممکن است مدعی حق یا نفعی در دعوای مطروحه باشد، در فرایندی شفاف فراهم گردد. دعاوی مختلف‌الاطراف در دادگاه‌های دولتی با امکان طرح دعوای ورود ثالث، صرف‌نظر از توافق طرفین ذی‌ربط، موردشناسایی قرار گرفته ولی در داوری به‌دلیل حکومت اصل آزادی اراده طرفین بر جریان داوری، ورود اشخاص ثالث حتی اگر منافعشان در داوری مطروحه تحت‌الاشعاع قرار می‌گرفت، بدون رضایت طرفین داوری ممکن نبود، چراکه از خصوصی و محرمانه بودن داوری به‌عنوان ویژگی‌های متمایزکننده آن از دعاوی مدنی نام ‌برده می‌شد و شخصی غیر از طرفین داوری، نه‌تنها نمی‌توانست در جریان دعوی به‌عنوان طرفی که منافعش به تبعیت از طرفین یا مستقلاً، درگیر بود، وارد شود بلکه حتی نمی‌توانست در جلسه استماع دعوی به‌عنوان شخصی بی‌طرف حضور پیدا کند. این رویه با تصویب قواعد آنسیترال راجع به شفافیت در داوری‌های مبتنی‌بر معاهده بین دولت و سرمایه‌گذار تغییر کرد و ورود ثالث نه‌تنها در جلسات استماع دعوی بلکه به‌عنوان یکی از طرفین دعوی نیز مجاز گردید و این تغییر تأثیرات عمده‌ای بر خصایص داوری گذاشت.}, keywords_fa = {خصوصی بودن,محرمانه بودن,ورود ثالث,قانون داوری ایران,قواعد آنسیترال,شفافیت}, url = {https://jlr.sdil.ac.ir/article_114215.html}, eprint = {https://jlr.sdil.ac.ir/article_114215_02493ab724781ebb8064cf8675ae4a91.pdf} }
