کاوشی انتقادی در نظریه ‌حق‌بنیاد در باب توجیه دفاع مشروع منجر به قتل

چکیده

یکی از نظریه‫های معاصر و پراهمیت در توجیه دفاع مشروعی که منجر به قتل مهاجم می‌شود، نظریه ‌حق‌بنیاد است که توسط جودیت جارویت تامسون، فیلسوف معاصر اخلاق، ارائه شده ست. این نظریه ادعا دارد که نقطه ثقل اخلاقی بودن و موجه بودن دفاع مشروع منجر به قتل آنجاست که مهاجم با انجام عمل ناموجه خود، حق اینکه از دیگران بخواهد که به حق کشته نشدن او احترام بگذارند را از دست می‌دهد و به‌عبارتی‌دیگر، مهاجم دیگر حق بر کشته نشدن ندارد و به این ترتیب مدافع می‌تواند بدون اینکه حقی از مهاجم را نقض کند، از خود دفاع نماید. یکی از مهم‌ترین ایراداتی که به این نظریه می‌توان وارد آورد، این است که اگر فرض را بر این بدانیم که مهاجم با حمله خود به قربانی/ مدافع، حق به کشته نشدن خود را از دست می‌دهد، چرا مدافع در عمل تدافعی خود هنوز بایستی مقید به این باشد که عمل تدافعی‌اش متناسب و ضروری باشد؟ طرفداران این نظریه نتوانسته‌اند پاسخ درخور و صحیحی به این ایراد بدهند و درنتیجه باتوجه‌به ایراد مذکور و سایر ایراداتی که به این نظریه وارد آمده است، این نظریه نمی‌تواند به‌عنوان یک نظریه کامل و جامع برای توجیه دفاع مشروع موردِاستناد قرار گیرد.

چکیده [English]

One of the significant theories for justifying self-defense that leads to the death of the aggressor is the right-based theory which has been put forward by the contemporary moral philosopher Judith Jarvis Thomson. According to this theory, the central core of the morality and justifiability of self-defense leading to death is that by perpetrating the unjustified deed, the aggressor loses the right not to be killed by others, so the defender can defend himself without violating any rights of the aggressor. One of the main objections that can be raised against this theory is that if the aggressor loses his right not to be killed by attacking the victim/ defender, how can the defender be bound by the constraints of necessity and proportionality in his defense? The proponents of this theory have not been able to give a satisfactory answer to this objection; due to this and some other objections that have been raised against this theory, it cannot be considered a comprehensive theory for justifying self-defense.
