ساختار و عملکرد دیوان آفریقایی حقوق بشر

چکیده

دغدغه اصلی مردم آفریقا به دلیل فقر، بیشتر تأکید بر حقوق نسل دوم بوده است، با این حال تأسیس دیوان حقوق بشر در سال 2006 در این قاره برای تضمین جمیع حقوق بشر گام مهمی بوده تا در کنار کمیسیون حقوق بشر آفریقا به ارتقای سطح کلیه حق‌های بشری کمک کند. این دادگاه از بدو تأسیس با مشکلاتی از قبیل کمبود منابع مالی، عدم رغبت کشورها به تصویب اساسنامه و محدودیت‌های صلاحیتی، مواجه بود. این چالش‌ها حتی بعد از لازم‌الاجرا شدن سند تأسیس این دیوان ادامه داشت و منجر به پیشنهاد ادغام دیوان حقوق بشر آفریقا با دیوان دادگستری آفریقا شد، در همین راستا پروتکلی تهیه شد که تاکنون لازم‌الاجرا نشده است. محدودیت‌های صلاحیت دیوان آفریقایی حقوق بشر در رسیدگی به شکایات اشخاص حقیقی و سازمان‌های غیردولتی موجب شده تا دیوان نتواند نقش قابل توجهی در تضمین حقوق بشر داشته باشد و پرونده‌های رسیدگی شده در آن اندک باشد.

چکیده [English]

Because of poverty, the main problem of African people is focusing on second generis of human rights. However constitution of African Court on Human and People’s Rights in 2006 besides African human rights commission could improve promotion of all human rights in Africa Continent. There were some problems from outset of constitution of the Court like financial sources, reluctance of States for approving the Constitution and some restrictions in jurisdiction of the court. These problems caused to a suggestion for merging of the Court and African court of justice. So a protocol has been signed but it’s not obliging yet. Restrictions in the Court for compulsory proceeding to claims of African citizens and NGO’s caused to low efficiency of Court for preserving human rights and low quantity of cases which have been proceeded.
