جایگاه عامل زمان در تفسیر معاهدۀ بین المللی

چکیده

تفسیر یکی از مهم ترین موضوع های حقوق تعهدات بین‌المللی است که در تنویر دامنۀ حقوق و تعهدات طرفین نقش مؤثری را ایفا می نماید. مادۀ 31 کنوانسیون حقوق معاهدات به قواعد کلی تفسیر اشاره دارد. یکی از این قواعد که مورد بحث حاضر قرار می گیرد پاراگراف (ج) بند 3 است که مقرر می دارد: «هر قاعدۀ مرتبط حقوق بین‌الملل که در روابط بین طرف های معاهده قابل اعمال باشد، همراه با سیاق عبارت در تفسیر مورد توجه قرار خواهد گرفت». اخیراً اعمال مقررۀ فوق در نزد مراجع بین‌المللی دارای اهمیت ویژه ای شده است و این حاکی از آن است که دیگر رجوع به اوضاع و احوال زمان انعقاد و زمان ابراز رضایت در تعهد نمی تواند برای سیستم سیال و پویای حقوق بین‌الملل کافی باشد. این امر به ویژه با برجسته شدن مفاهیم حقوق بشری و ضمانت اجراهایی چون قواعد آمره و تعهدات عام الشمول که منجر به تغییر پاره ای از مفاهیم شده است، نیاز به یک تفسیر یکپارچه را برای متعادل سازی روابط حقوقی موجب شده است. همچنین تفسیر براساس تحولات بعدی و قواعد مرتبط می تواند در رفع تعارض و انسجام حقوق بین‌الملل مؤثر باشد که امروزه حقوق بین‌الملل با گونه‌گونی مواجه شده است.

The interpretation is one of the most important issues in the law of international obligations as plays a significant role in clarification of the scope of rights and undertakings. Article 31 of the Vienna Convention on the Law of Treaties (1969) indicates general rules of interpretation. We shall review, herein, one of those general rules as come under Paragraph 3 (c) of the said article. Article 31. 3 (c) provides that “any relevant rules of international law applicable in the relations between the parties” “shall be taken into account” for the interpretation purposes, “together with the context”. The international authorities have recently paid particular attention to the capabilities of this provision to determine the obligation/s. This implies that returning to the circumstances of the time of creation of the obligation would no longer be sufficient for the interpretation purposes under current dynamic system of the international law. Indeed, establishing a consolidated interpretation regime which can stabilize international legal relations becomes necessary specifically in light of the fact that the human rights as well as jus cogent and erga omnes obligations are gaining in increasing significance. Meanwhile, taking the “subsequent developments” and the “relevant rules” into consideration for interpretation purposes may be helpful to satisfy certain contradictions that the international law may be faced with in specific occasions.
