حقوق ایران نسبت به نقاط مداری از دیدگاه حقوق بین الملل

چکیده

مدار ثابت‌زمین به‌عنوان مداری باارزش و منحصربه‌فرد که در اطراف کرة زمین قرار گرفته و از ظرفیت محدودی برخوردار است، از دیرباز، همواره مورد دعاوی بسیاری از سوی کشورهای جهان بوده و تاکنون جنجال‌های متعددی بر سر وضعیت حقوقی آن ازجمله تصاحب نقاط این مدار، صورت گرفته است. ازجمله بارزترین ادعاهای مطروحه در این زمینه، ادعای کشورهای استوایی است که فعالیتشان از دهه 70 به‌طور جدی آغاز گردید و متعاقب آن منجر به صدور اعلامیه بوگوتا شد، ولیکن علی‌رغم تمام تلاش‌های صورت‌گرفته توسط این گروه از کشورها، استدلالات آنها نهایتاً ره به جایی نبرد و کشورهای استوایی به دلیل مخالفت شدید سایر کشورها و عدم برخورداری از حمایت حقوق‌دانان بین‌المللی نتوانستند راهی را برای اعمال حاکمیت ملی و انحصاری دولت‌هایشان، بر بخش‌هایی از مدار ثابت‌زمین بگشایند.
ادعاهای کشورهای استوایی رفته‌رفته سبب گردید که توجه حقوق‌دانان و جامعة بین‌المللی جهت یافتن راهی مناسب برای حل‌وفصل اختلافات موجود در این بخش از حوزه حقوق فضا افزایش یابد و سرانجام به نظامی قانونمند تبدیل شود.
وضعیت نقاط مداری ایران هم با این‌گونه از اختلافات و دعاوی بین‌المللی بیگانه نبوده و همواره موردتوجه و ادعاهای دیگران بوده است؛ زیرا تأخیر دولت ایران در استقرار ماهواره‌ها در بخش‌های ثبت‌شده ـ 26، 34 و 47 درجة شرقی مدار ـ سبب گردیده که تاکنون دو نقطة مداری از نقاط ارزشمند مزبور را از دست بدهد و تنها مدار باقی‌مانده در معرض خطر تصرف از سوی کشورهای دیگر قرار گیرد، ازاین‌رو مقالة حاضر درصدد بیان راهکاری برای این حل این مسئله می‌باشد.

چکیده [English]

The geostationary orbit as a valuable and unique orbit exist around the earth and known as a limited natural resource. From past till now many countries have been contributed in many legal disputes about this orbit because of its ownership and legal status. one of the most important of these claims declare from equatorial countries that started their activities from 70`s decade seriously and result in issuance of Bogota declaration but their arguments confront with severe dissent of other countries and international jurists did not protect or accompany with their allegments.
These claims result in jurists and international society notice to find a suitable way to settlement these kinds of disputes and attempting to find a legal system to regulate the use of GSO.
Also our country Iran, confront with some challenges because of it’s orbit points, because of our delay to launch and stabilization of satellites in 26, 34 and 47 points, unfortunately we lost two of these orbit points and there is the risk of losing the other. This article discuss about the problem and the way we can keep our orbit points
