آثار حقوقی تصمیم خروج کشورهای آفریقایی از دیوان بین‌المللی کیفری

چکیده

پس از تشکیل دیوان بین‌المللی کیفری و تحقق آرزوی چندین‌ساله جامعه جهانی مبنی بر وجود یک مرجع کیفری بین‌المللی، انتظار می‌رفت که این نهاد رفته‌رفته به نقطه عطفی برای مبارزه با بی‌کیفری در جهان تبدیل شود. به‌خصوص در رابطه با کشورهایی که از نقض شدید حقوق بشر رنج می‌برند؛ اما رسیدگی به پرونده‌هایی که موضوع آن صرفاً کشورهای آفریقایی است، اعتراض گروه قابل‌توجهی از کشورهای آفریقایی را برانگیخت. این گروه، دیوان را به گزینشی عمل کردن متهم می‌کنند و دیوان را وسیله‌ای در دست غرب، جهت اعمال تبعیض و بی‌عدالتی نسبت به مقامات و ملت‌های آفریقایی تلقی می‌کنند و از آن با عنوان استعمار نو یاد می‌کنند. لذا برای مقابله با آن ایدۀ خروج از اساسنامه دیوان بین‌المللی کیفری را مطرح ساختند. عملی ساختن این ایده، بی‌تردید آثار حقوقی جدی و مهمی هم برای آینده دیوان و هم برای قاره آفریقا در پی خواهد داشت. در قبال این تصمیم، واکنش‌های تند و بعضاً شدیدی از سوی جامعه جهانی وجود داشته است که ادعای آفریقایی‌ها را مستند و مدلل نمی‌دانند و اساس ادعای آنان و تصمیم خروج را بهانه‌ای برای فرار از عدالت قلمداد می‌کنند.

چکیده [English]

After establishing the International Criminal Court (ICC), by passing the time, it was expected that ICC became turning point in terminating the impunity in the world. Especially in concern of those countries that suffer from human rights breaks. But as all of the cases that the ICC is currently investigating and prosecuting have to do with crimes allegedly committed in countries in Africa. This has raised questions as to whether this is an example of the selectivity of international criminal law. African nations believe that the International Criminal Court is targeting Africa in its prosecutions. The ICC has been undermining African states. So Africans Threat that they will withdraw from ICC. If they do, definitely, it will give rise to serious legal effects for both ICC and Africa. In other hands, this decision caused the serious protest around the world. This group believes that African’s claim is not reasonable and rational. This claim is only an excuse for quailing the justice.
