تعارض میان منفعت عمومی جامعه و منفعت فردی دولت‌ها: گذار از اصل مصونیت در پرتو تحول حقوق بین‌الملل کیفری

چکیده

بنابر رویکرد عامه، منافع جامعه هر جایی که مطابق حقوق بین‌الملل موردِحمایت قرار گرفته و برای نظام، حیاتی تلقی شده‌اند باید بر منافع فردی دولت‌ها برتری داده شوند. مبنای این برتری، آن است که ارزش‌های ذی‌ربط برای همه مفید هستند. البته باید این توافق درمورد تضمین منافع جامعه وجود داشته باشد حتی در جایی که به قیمت فدا شدن منافع و نادیده گرفتن قلمروی فردی دولت‌ها تمام شود. به‌طور نمونه، درزمینة مبارزه علیه بی‌کیفر ماندن جرایم بین‌المللی با شناسایی صلاحیت جهانی و تأسیس دادگاه‌های کیفری بین‌المللی، محدودیت‌هایی بر حاکمیت دولت‌ها تحمیل شده است که استثنائاتی بر مصونیت دولت‌ها قلمداد می‌گردد. حقوق بین‌الملل معاصر درصدد برقراری نوعی توازن یا تعادل میان منافع عمومی جامعه و منافع فردی دولت‌ها می‌باشد. مدت‌های مدید در عرصه حقوق بین‌الملل کلاسیک، اصل مصونیت قضایی مأموران عالی‌رتبه دولتی، مانع از پاسخگویی و مسئولیت‌پذیری آنان در قبال قربانیان و تحقق اجرای عدالت درمورد آنان می‌شد، لیکن امروزه در پرتو توسعه و تحول حقوق بین‌الملل ازجمله نهادینه شدن حقوق بین‌الملل بشر ـ که جنبۀ حمایت‌گرایانه دارد ـ و توسعه تدریجی حقوق بین‌الملل کیفری معاصر، سخن از لزوم پایان دادن به بی‌کیفری ناقضان حقوق بشر و تحقق عدالت ترمیمی قربانیان نقض‌های شدید حقوق بشر، در دادگاه‌های کیفری بین‌المللی به مرحله عمل رسیده، اگرچه هنوز هم تا تحقق کامل عدالت، فاصلۀ زیادی در پیش است.

چکیده [English]

Public interest of International community is one of the most important issues of modern International Law, and it is superior to private interest of individual states. The basis of this superiority is the common values and interest of international community as a whole. To protect and insure of the public interest of international community implies the limitation of individual interest of states. Elimination of impunity causes the establishment of international criminal courts. The goals of International Criminal Law have restricted the principle of impunity and International Criminal Law based of the responsibility and accountability in response to the International crimes. One of the most important issues in the Modern International Law is arranging the conflict between public interests of the community and the individual interest of the states.
The purpose of International Criminal Law is protection of the victims of gross and serious violations of International Human Rights Law and International Humanitarian Law. The advent of the jus-cogense and erga-omnes obligations has caused some limitations on the absolute immunity and sovereignty of the states in International Law since recent decades, but for more developments, we should expect in future.
