This study has aimed to explain the International Court of Justice's fundamental approach to the rules governing the responsibility of non-state actors in international relations through the Nicaragua case verdict. To examine, effective control was investigated as the principle governing governments' international responsibility concerning the Nicaragua verdict as the basis for the issuance of the International Court of Justice's verdict. Furthermore, the ruling of the former Yugoslavia's Criminal Court, in conflict with the ruling of the court, will be discussed. Finally, the necessity of a change in the approach and the rules governing the international responsibility of governments will be debated. The results obtained from the present study have indicated that the ruling procedure of the court of justice has undergone certain changes after the Nicaragua case of 1989 regarding assignment of the actions of the non-state actors to the supporting government; otherwise, international law would not be responsive to the new legal incidents and questions, rendering it ineffective in serving justice with criteria such as effective control. Thus, to guarantee basic human rights, international law must pay special attention to other numerous progressive criteria, namely overall control; these criteria shall be theorized in this section of the international law. The Nicaragua verdict is based on a realistic theory regarding international relations and international law, which could be cited as a reliable source in its own time. However, nowadays, as idealistic theories regarding basic human rights gain power, it could be claimed that the basis of the issuance of the Nicaragua verdict is not effective in explaining and analyzing the responsibility of the supporting governments and non-state actors in the violation of the humanitarian obligations.}, keywords = {International Court of Justice,international responsibility,Non-state actors,Nicaragua Case}, title_fa = {مبنای رویکرد دیوان دادگستری بین‌المللی به قواعد حاکم بر مسئولیت دولت‌ها در قبال اَعمال بازیگران غیردولتی در روابط بین‌الملل؛ مطالعه موردی رأی قضیه نیکاراگوئه}, abstract_fa = {مسئولیت دولت‌ها در قبال اِعمال بازیگران غیردولتی در روابط بین‌الملل از موضوعات محل اختلاف بین‌المللی است که با روند فزاینده جنگ‌های نیابتی منطقه‌ای، تبیین و تحلیل آن امری ضروری است. هدف مقاله حاضر تبیین مبنای رویکرد دیوان به قواعد حاکم بر مسئولیت دولت‌ها در قبال اَعمال بازیگران غیردولتی در روابط بین‌الملل با تبیین رأی قضیه نیکاراگوئه است. به‌منظور بررسی موضوع موردِاشاره، کنترل مؤثر به‌عنوان اصل حاکم بر مسئولیت بین‌المللی دولت‌ها که قضیه نیکاراگوئه مبنای صدور رأی دیوان دادگستری بین‌المللی قرار گرفته، بررسی شده است. در ادامه از رأی دیوان کیفری یوگسلاوی سابق که با رأی دیوان در تعارض است بحث شده و سرانجام از ضرورت تغییر رویکرد و قواعد حاکم بر مسئولیت بین‌المللی دولت‌ها سخن به میان آمده است. نتایج مقاله بیانگر این امر است که رویه قضایی دیوان بعد از قضیه 1989نیکاراگوئه و درمورد انتساب اَعمال بازیگران غیردولتی به دولت حامی دچار دگرگونی شده زیرا درغیراین‌صورت حقوق بین‌الملل پاسخگوی سؤالات و رخدادهای جدید حقوقی نبوده و نمی‌تواند با معیارهایی مثل کنترل مؤثر، عدالت را تأمین نماید. ازهمین‌رو باید برای تضمین حقوق بنیادین بشر، حقوق بین‌الملل به معیارهای مترقی متعدد دیگری چون کنترل کلی بیشتر توجه کرد و آن را در این بخش از حقوق بین‌الملل تئوریزه کرد. رأی نیکاراگوئه برمبنای نظریه رئالیستی روابط بین‌الملل و حقوق بین‌الملل است که در زمانه خود قابل‌استناد بوده است ولی امروزه با قدرت گرفتن نظریه ایدئالیستی که حول محور حقوق بنیادین بشر شکل گرفته است می‌توان تحلیل کرد که مبنای صدور رأی نیکاراگوئه در تبیین تحلیل مسئولیت کشورهای حامی و بازیگران غیردولتی در نقض تعهدات حقوق بشردوستانه کارآمد نیست.}, keywords_fa = {دیوان دادگستری بین‌المللی,مسئولیت بین‌المللی,بازیگران غیردولتی,قضیه نیکاراگوئه}, url = {https://jlr.sdil.ac.ir/article_134518.html}, eprint = {https://jlr.sdil.ac.ir/article_134518_4c17d28106c2e2f72d50c7f2d357cdcb.pdf} }
