Regulation of the genocide convention provided the ground for the legal scrutiny on genocide and crimes against humanity by international tribunals and international lawyers; they sought to find similarities and differences between two crimes by appealing to the teachings of the most highly qualified publicists and domestic and international jurisprudence. The result of this study indicates their approach in material elements and emphasis on the mental element as the only ruby in the heart of the crime of genocide. Considering that the crime of genocide has been emerged from the heart of crime against humanity, it suddenly raises this concern “Is it justifiable to call it the Crime of Crimes among the serious international crimes simply because of issuing a verdict from authority especially that we have witnessed the efforts of ILC in drafting the convention of crimes against humanity and concluding it in recent years”? Realization of such effort is reaffirmation of the heinous nature of the two crime and discrediting the existence of a hierarchy among serious crimes. In fact, the consequences of labelling the Crime of Crimes on the forehead of the government cause bypassing all routes and finding a way to read genocide as crime against humanity.}, keywords = {Genocide,Crimes against humanity,material elements,special intent,the Crime of Crimes}, title_fa = {ژنوسید: از مصداقی از جنایات علیه بشریت تا جرم الجرائم در حقوق بین الملل کیفری}, abstract_fa = {زمزمه‌هایی که از اوان طرح ایده جرم‌‌انگاری جنایت ژنوسید در مجامع داخلی و بین‌المللی به گوش می‌رسید عمدتا با اعطای هویتی مستقل به این جنایت مخالف بوده و نظر بر سبقه رسیدگی در نورنبرگ خواهان برجای ماندن آن به عنوان فقره‌ای ذیل جنایات علیه بشریت بودند. تنظیم کنوانسیون ژنوسید زمینه تدقیق و تعمّق حقوقی بر ژنوسید و جنایات علیه بشریت را ازسوی دادگاه‌های بین‌المللی و حقوقدانان بین‌المللی فراهم آورد؛ به گونه‌ای که با توسل به نظرات برجسته‌ترین مبلغان حقوقی و رویه قضایی داخلی و بین‌المللی درپی یافتن نقاط اشتراک و افتراق میان دو جنایت برآمدند. نتیجه این بررسی دلالت بر نزدیک شدن آن‌ها در عناصر مادی ازیک سو و تأکید بر عنصر روانی به عنوان یگانه یاقوت ممیِّز در دل جنایت ژنوسید دارد. با عنایت به اینکه جنایت ژنوسید از دل جنایات علیه بشریت بیرون کشیده شده به ناگاه این دغدغه را به میان می‌کشد که آیا جرم الجرائم خواندن آن در میان جنایات خطیر بین‌المللی به صرف صدور رأیی از مرجع رسیدگی کننده محلی از اعراب دارد به ویژه اینکه در سال‌های اخیر شاهد تلاش کمیسیون حقوق بین‌الملل در تنظیم پیش‌نویس کنوانسیون جنایات علیه بشریت و به بار نشاندن آن بوده‌ایم. به ثمر نشاندن چنین کوششی مهر تأیید دوباره بر شنیع و جدی بودن دو جنایت و بی اعتباری وجود سلسله مراتب میان جنایات خطیر است. درحقیقت عواقبی که برچسب ارتکاب جرم‌الجرایم بر پیشانی دولتی می‌زند درموارد عدیده‌ای سبب دور زدن تمامی مسیرها و یافتن مفرّی برای خواندن ژنوسید به نام جنایات علیه بشریت بوده است.}, keywords_fa = {ژنوسید,جنایات علیه بشریت,عناصر مادی,قصد ویژه,جرم الجرائم}, url = {https://jlr.sdil.ac.ir/article_151754.html}, eprint = {} }
