Journal Article 2025 08 19 Abstract<br>In the present era, human dignity is considered as the ideal foundation of human rights and the desired goal of humanity. However, a comprehensive definition has not been achieved so far; hence, its manifestations are examined. Among the manifestations, we can mention the right to life, freedom of expression, freedom of religion, and the right to equality, which have been emphasized in documents and conventions. The term human dignity and standing is used in all documents related to human rights, and in some of these documents, the dignity of groups such as women and children has been emphasized. The examples examined include: the Universal Convention on Human Rights, the United Nations and its organs, the Declaration of the International Conference on Human Rights, the opinions of the International Court of Justice and the European courts. Unfortunately, the results of the study showed that the concept of human dignity is interpreted differently in the interpretation of the expansion of private rights. In international documents, the phrase "human honor" is often used instead of the concept of human dignity, while the concept of human dignity has not been addressed at all in human rights discussions. The findings show that human dignity, as the central core of international human rights, plays a decisive role in promoting justice, ensuring peace, and preventing violations of fundamental human rights, and the concept of human dignity in human rights documents ensures that there is a common basis for judicial interpretation among judges in judicial practice. چکیده<br>در عصر حاضر، کرامت انسانی به عنوان بنیان آرمانی حقوق بشر و هدف مطلوب بشریت مطرح است. جایگاه کرامت در اسناد بین‌المللی همواره در حال تحول و تکامل است و متاسفانه تاکنون به یک تعریف جامع دست نیافته است؛ از این رو برای روشن کردن جایگاه آن، ناگزیر ابعاد و نمودهای آن مورد بررسی قرار می‌گیرد. از جمله این نمودها می‌توان به حق حیات، آزادی بیان، آزادی مذهب و حق برابری اشاره کرد که بر آنها در کنوانسیون‌ها و اسناد گوناگون تأکید شده است. امروزه اصطلاح کرامت و منزلت انسانی در تمامی اسناد مربوط به حقوق بشر به کار می‌رود و در برخی از این اسناد بر کرامت گروه‌های ویژه‌ای مانند زنان، کودکان، پناهندگان مهاجر تأکید شده است. نمونه‌های مورد بررسی تحقیق عبارت‌اند از: کنوانسیون حقوق بشر جهانی، کنوانسیون پناهندگان، کنوانسیون اروپایی حقوق بشر،منشور حقوق اجتماعی اروپا، اعلامیه حقوق بشر اسلامی، اعلامیه کنفرانس بین‌المللی حقوق بشر، ولی متاسفانه نتایج بررسی نشان داد که از مفهوم کرامت انسانی در تفسیر گسترش حق های خصوصی تفاسیر متفاوتی میشود که با آموزه های دینی ما همخوانی ندارد. در اسناد بین المللی غالباً از عبارت "حیثیت انسانی" بجای مفهوم کرامت انسانی استفاده شده، ضمن اینکه در مباحث حقوق بشری اصلاً به مفهوم کرامت انسان پرداخته نشده است. یافته ها نشان می دهد که ایده و توجه به مفهوم کرامت انسانی در اسناد حقوق بشری باعث می شود که در رویه قضایی مختلف یک مبنای مشترک برای تفسیر قضایی بین قضات وجود داشته باشد. https://jlr.sdil.ac.ir/article_232867_cb1e8785e19bf3759968d7d1c08c74a9.pdf
