The Role of Hermeneutics in the Interpretation of International Law Norms

Abstract
One of the fundamental characteristics of legal norms underpinning the international legal order is their formulation in general terms. This generality gives rise to persistent and significant challenges in their application to concrete cases. In practice, the efficacy of legal norms in addressing international disputes may be compromised due to indeterminacy. To ensure that legal norms can be applied to specific factual scenarios, a complementary process is indispensable. This complementary process involves elucidating the norm’s meaning, contextualizing its application, and ascertaining its normative intent. Only through this approach can legal silence, ambiguity, generality, and lacunae be addressed, thereby providing definitive solutions to disputes; otherwise, the international community risks perpetuating legal and normative gaps. The search for a norm's normative intent is encapsulated by terms such as interpretation, construction, and juridical hermeneutics. This descriptive-analytical study, employing library research methods, examines the role of hermeneutics in interpreting international law norms. The research findings demonstrate that adopting a hermeneutic approach grounded in contemporary hermeneutical theory can effectively resolve ambiguity and conflicts in interpreting international law norms.
