جایگاه حقوق بین‌الملل فناوری در توسعه و نظم‌دهی هوش مصنوعی: تحلیلی بر نخستین قطعنامه مجمع عمومی سازمان ملل متحد درخصوص هوش مصنوعی

چکیده
هوش مصنوعی به یکی از قدرتمندترین فناوری‌های جهان تبدیل شده و ظرفیت تغییر بسیاری از جنبه‌های زندگی بشر را دارد. از این ‌رو ایجاد چهارچوبی جهانی برای توسعه و استفاده مسئولانه از این فناوری ضروری است. پژوهش حاضر با هدف بررسی جایگاه حقوق بین‌الملل فناوری در توسعه و نظم‌دهی هوش مصنوعی و تحلیل راهبردهای جهانی ایجادشده در نخستین قطعنامه مجمع عمومی سازمان ملل متحد درباره هوش مصنوعی، با روش توصیفی ـ تحلیلی انجام شده است. حقوق بین‌الملل فناوری با فراهم‌کردن چهارچوبی حقوقی، منطقی و منسجم برای توسعه و استفاده از هوش مصنوعی، نقشی اساسی در هدایت و توسعه مسئولانه این فناوری ایفا می‌کند. تصویب نخستین قطعنامه مجمع عمومی سازمان ملل متحد درباره هوش مصنوعی نیز نشان‌دهنده توجه جامعه بین‌المللی به اهمیت و آثار این فناوری است و می‌تواند به‌عنوان چهارچوبی راهنما برای توسعه مسئولانه و پایدار هوش مصنوعی مورد توجه قرار گیرد. این قطعنامه با تأکید بر حمایت از حقوق بشر و امنیت جامعه، می‌تواند در پیشگیری از سوءاستفاده و استفاده غیراخلاقی یا غیرقانونی از هوش مصنوعی مؤثر باشد. تنظیم و توسعه هوش مصنوعی در چهارچوب حقوق بین‌الملل فناوری، ضمن فراهم‌کردن زمینه بهره‌گیری مسئولانه و پایدار از این فناوری، می‌تواند به حمایت از حقوق بشر، ارتقای امنیت جامعه و کاهش مخاطرات ناشی از استفاده نادرست از هوش مصنوعی منجر شود.

Artificial intelligence has become one of the world's most powerful technologies, with the potential to transform numerous aspects of human life. Establishing a global framework for its responsible development and use is therefore essential. Employing a descriptive-analytical method, this article examines the role of international technology law in the development and regulation of artificial intelligence and analyses the global strategies outlined in the first United Nations General Assembly resolution devoted to AI. International technology law plays a fundamental role in guiding the responsible development of artificial intelligence by providing a coherent legal framework for its development and use. The adoption of the General Assembly's first AI resolution reflects the international community's recognition of the significance and implications of this technology and provides guidance for its responsible and sustainable development. By emphasizing the protection of human rights and public safety, the resolution may help prevent the misuse of AI and discourage its unethical or unlawful applications. Regulating and developing artificial intelligence within the framework of international technology law can facilitate its responsible and sustainable use while contributing to the protection of human rights, the promotion of public safety, and the mitigation of risks associated with its misuse.
