Abstract

Cheque, as one of the commercial documents. playes an important role on increasing remittance. so. enacting the best regulation about cheque is important for legislator to sustain its position. From past to now. many regulations were enacted about it. and the last one is for the reformation of Issuance Cheque Code in 1397.
Based on this Act. different issue of the cheque has a lot of changes and one of the most important. is about the legal sanction of cheque. some of them. reform the past regulations and create some changes on it. and the others. are the innovation of legislator in new Act. For example demand the cheque from Judgment Enforcement Unit without judicial proceeding, and enact the legal sanction about banking system. Totally enacting such as these legal sanctions with non-criminal approach. shows that the legislator replaces the oppressive policy to the legal approach for collect the bounced cheque.
