The Challenge of Enforcing Decisions Arising from Alternative Dispute Resolution (ADR) Methods and its Legal Management

Abstract
Given the existence of certain deficiencies in resolving disputes through judicial courts and arbitration, parties sometimes decide to utilize non-judicial methods such as negotiation, mediation, conciliation, or mini-trial to resolve their disputes. These methods, which in international trade law are known as "ADR" or Alternative Dispute Resolution methods, face a fundamental challenge regarding the enforcement of outcomes; such that if this challenge is not identified in advance and legally managed, the use of ADR methods will only lead to a waste of the parties' time and energy, and they will be forced to revert to litigation or arbitration. This article, seeking to fill a research gap, aims to answer the question: what are the main challenges of enforcing decisions arising from ADR methods? The research method is descriptive-analytical and relies through library resources and sample awards and cases in this field. The provable hypothesis is that the challenge can be reduced by proactive planning and management to reduce the risk arising from ADR methods; therefore, it is necessary for the risk of non-enforcement to be identified in advance and legally managed.
