Abstract

The right to free education and training enjoys a special status in human rights documents, as well as in domestic laws and constitutions of countries. This right is enshrined in the Constitution of the Islamic Republic of Iran and emphasized in ordinary laws. However, the right to free education in Iran has always faced significant challenges. This research aims to answer the fundamental question of what challenges and damages the right to free education, as stated in the Iranian constitution, faces. The study uses a descriptive-analytical method and collects necessary information and resources through library research. The result of the research indicates that the government, in the general sense of all governing bodies, according to the constitution, must address severe issues such as providing sufficient budget, outlining a sustainable policy in the education system, focusing on the principle of free, Public, and compulsory education, paying attention to the welfare of teachers, and adapting education to the values and culture of immigrants. On the other hand, the Ministry of Education must also address important internal issues in accordance with higher-level documents such as the Fundamental Transformation Document. These issues include addressing the shortage of human resources, creating diversity in textbooks and educational materials, establishing appropriate infrastructure for information and communication technology, paying attention to the education of girls, expanding educational justice, freedom of choice in the type of education, and reforming the structure.
