An Introduction to the Pragmatic Grounds for Interpreting Fiqhi Literature on Sale (Bay') and Options of Cancellation (Khiyarat)

Abstract
Sale (Bay') and options of cancellation (Khiyarat) are among the most important subjects in the domain of jurisprudential (fiqhi) texts, as well as the legal and judicial system of Iran. Given that the principles for deducing legal rulings (istinbat al-ahkam) are text-centric, the pragmatic presupposition of jurists is that the Sacred Lawgiver (al-Shari'), like other rational persons, indeed, as the foremost among them, has utilized common human methods for conveying meaning and messages in the realm of rhetoric. In light of this presupposition, one may ask: what are the most important of these methods and foundations, and what linguistic norms and frameworks constitute them? In other words, how and by what methods have linguists in the field of Islamic jurisprudence (fiqh), that is, experts in language (ahl al-lisan) and jurists, succeeded in discovering and interpreting meaning for deducing certain rulings in the domain of sale and options of cancellation? In this paper, the author, utilizing a descriptive-analytical method and relying on certain library sources from jurisprudential texts on sale and concomitant options, introduces applications of intertextuality, the principle of limited interpretation, presuppositions, etc., as among the most fundamental foundations in the pragmatics of jurisprudential texts.
