Abstract
Artificial intelligence in medicine has transformed the methods of diagnosis, treatment, and clinical decision-making at an unprecedented pace. The use of disease diagnosis approaches and machine learning systems has provided the ability to analyze medical data, increasing the accuracy of diagnosis and accelerating the treatment process.However, the increasing dependence of physicians on the decisions of these systems has raised questions about the limits and bases of their civil liability in the event of an error. The research method of this study is analytical-descriptive and is structured around answering this question.Who should be held responsible if an error occurs in the AI-based diagnosis or treatment process, and on what basis can one distinguish between human error and technological failure? The research findings indicate that the physician's liability should be determined based on the standard of professional caution in using the technology and the degree of reliance on the system's output.Also, the technology manufacturer will be independently liable in the event of design flaws, data bias, or lack of adequate warnings about access limitations.
