Balancing AI-Enabled Satellite Remote Sensing and Privacy and Personal Data Protection: A Comparative Analysis of the United States and the European Union

Abstract
In the contemporary era, artificial intelligence-powered remote sensing satellites are increasingly utilized for purposes such as natural disaster management and environmental protection. Nevertheless, the use of this technology raises significant challenges concerning privacy and data protection. Advancements in remote sensing technology, improved image resolution, and the integration of artificial intelligence have increased the potential risks of infringing upon individuals’ privacy and personal data.
At the international level, despite the existence of instruments such as the Outer Space Treaty and the Principles Relating to Remote Sensing of the Earth from Outer Space, there is still no specific legal framework directly addressing the misuse of satellites or privacy violations arising from remote sensing activities. In this regard, the present study seeks to examine the existing legal frameworks governing artificial intelligence-enabled remote sensing activities, personal privacy, and data protection within the United States and the European Union, both of which have undertaken legislative initiatives in this area.
This research employs a descriptive-analytical method and relies on library-based data collection. The findings indicate how the existing legal and regulatory frameworks of the European Union and the United States can contribute to establishing an appropriate balance between the utilization of artificial intelligence-powered remote sensing satellites and the protection of privacy rights and personal data
