تعیین نظام حقوقی حاکم بر پروازهای تفریحی فضایی

چکیده

صنعت گردشگری فضایی از نوظهورترین پدیده‌‌های موجود در عرصة فعالیت‌‌های فضایی می‌‌باشد. وسایلی که به منظور فرستادن انسان به فضا استفاده می‌‌شوند دارای ماهیت دوگانة هوافضایی هستند. به علاوه مرز بین هوا و فضا تاکنون مشخص نشده است. شوربختانه در اسناد حقوق فضا نیز هیچ اشاره‌‌ای به پروازهای تفریحی فضایی و نظام حقوقی حاکم بر آنها نشده است. موضوعات پیش‌‌گفته تعیین نظام حقوقی حاکم بر این پروازها را با مشکل دوچندان روبرو می‌‌کند. از این رو حقوقدانان برای تعیین نظام حاکم بر این قبیل پروازها، دو رویکرد فضایی و عملی را پیشنهاد داده‌‌اند. در این نوشتار بعد از بررسی دو رویکرد مذکور و تعیین نظام حقوقی حاکم بر پروازهای تفریحی فضایی به موضوع مسؤولیت شرکت‌‌های خصوصی متصدی پروازهای تفریحی خواهیم پرداخت.

Space tourism is one of the most newfangled space activities. Vehicles which are used in order to transfer persons into space have hybrid nature and are called space-plane. Besides, the boundary between air space and outer space still is not determined. Unfortunately, commercial space flights are not mentioned in space treaties. These facts make the determination of legal regime governing on commercial space flights much more difficult. Therefore, experts of international law suggested two approaches (special and practical). In this article, at first these two approaches will be studied and the legal regime governing space flights will be determined, then the issue of private sector’s liability will be under consideration.
