The approach of the legal system of Iran and the European Union towards utility tokens

Abstract
On the one hand, utility tokens provide access to services based on distributed ledger technology, and on the other hand, new business owners have invented a new way of attracting capital by using it. A method that can reduce many administrative procedures in capital providing companies, and at the same time, by using distributed ledger technology without the presence of an intermediary person to confirm the financing process, gain credibility from the public participants in the financing process around the world. to receive This type of financing brings many legal challenges; Because the issuance and supply of such tokens is not realized through the traditional legal methods and paths determined by policymakers and legislative bodies, but all processes are done through distributed ledger technology in a decentralized manner and sometimes It is realized centrally through cryptocurrency service providers. The present research, based on descriptive and analytical methods and based on library sources, concludes that Iran's legal system has adopted a passive regulatory approach towards the issuance and supply of utility tokens. On the other hand, while separating utility tokens from other existing tokens, according to their nature and goals, the European Union has established specific requirements and regulations regarding their supply, issuance and service provision
