ظهور روندی جدید در تفسیر صحیح قطعنامه‌های شورای امنیت: از معمای تعمیم قواعد عام تفسیر تا تخصیص تفسیری خاص برای یک نهاد مخصوص

چکیده

در دو سال اخیر روندی در حقوق بین‌الملل قوام یافته که بر تفسیر صحیح قطعنامه‌های شورای امنیت تأکید دارد. نوع تفسیر قطعنامه‌ها تأثیر شگرفی بر اجرای آنها می‌گذارد. در پرونده هسته‌ای ایران شورای امنیت تعدادی قطعنامه علیه برنامه هسته‌ای تصویب کرد؛ دولت‌های غربی با سوءتفسیر و بعضاً تفسیر غلط، اقدامات فراقطعنامه‌ای و تحریم‌هایی یک‌جانبه علیه ایران اتخاذ نمودند. در صورت اِعمال تفسیر صحیح قطعنامه‌های شورای امنیت، چنین اقداماتی در حقوق بین‌الملل محلی از اِعراب نداشته و روندی مناسب و درست برای تفسیر و اجرای قطعنامه‌های آتی شورا ایجاد می‌نماید.

چکیده [English]

In recent two years, a procedure has taken place in international law that emphasizes on correct interpretation of Security Council resolutions. The interpretation of the resolutions has a huge impact on their implementation. In Iran nuclear issue, the Security Council adopted number of resolutions against Iran’s nuclear program. Based on misinterpretations, western governments imposed unilateral sanctions against Iran and have gone beyond Security Council resolutions. With correct interpretation of Security Council resolutions, these measures and misinterpretations can’t be accepted in international law and appropriate procedure would be taken place in future.
