ضرورت تطور مفهوم «ژنوسید» در پرتو تحول ارزش های جامعه بین المللی: ظرفیت نظم حقوقی کنونی در حمایت از حق وجود گروه

چکیده

در دهه‌های اخیر شتاب روزافزونی در سیر جامعه بین‌المللی قراردادی به سمت جامعه بین‌المللی ارزش‌ها صورت گرفته است. این تغییر اساسی در بنیان‌های نظم عمومی بین‌المللی و حرکت به سوی حمایت فراگیر از افراد و گروه‌ها، بازنگری در مقرراتی را ضروری می‌سازد که با بینش حقوق بین‌الملل حاکمیت محور وضع شده‌اند. مفهوم «ژنوسید» که در یکی از حساس‌ترین مقاطع تاریخ، دوران دوقطبی، شکل حقوقی یافت باید با ارزش‌های نوین جامعه بین‌المللی که رنگی بشری‌تر یافته بیش از گذشته مأنوس و همراه شود؛ بدین ترتیب از رهگذر وضع نامی متناسب می‌توان همه گروه‌های بشری را بر خوان برخورداری از حق وجود و حق حیات نشاند و با تحولات لایه‌های زیرساختی جامعه بین‌المللی همگام شد. بررسی پیشینه جرم انگاری این جنایت گواهی می دهد حمایت از تنوع از گروه ها مقصد اولیه جامعه بین المللی در جریان تنظیم کنوانسیون بوده است با این وجود عبارت پردازی کنونی تعریف ژنوسید در کنوانسیون پیشگیری و مجازات جنایت ژنوسید این شبهه را به اذهان افکنده است که این سند به منظور حمایت از اقلیت ها شکل گرفت و بدین جهت امکان گستردن چتر حمایتی کنوانسیون به سایر گروه ها وجود ندارد. خوشبختانه جامعه شناسان با مواجهه واقعیات اجتماعی و تشخیص آسیب‌های اجتماعی چون طبیبانی حاذق قلم به دست گرفته و در پی علاج این بیماری آثار گرانبهایی را پدید آورده‌اند. از رهگذر آثاری که این اندیشمندان درخصوص توجه به واقعیات اجتماعی و لزوم حمایت از سایر گروه های مورد حمایت کنوانسیون به رشته تحریر درآورده اند می توان به قانونگذاری جامع و کارآمد دل بست.

In recent decades increasing acceleration has taken place in the course of the international contractual community towards the international community of values. This fundamental change in the foundations of international public order and moving towards comprehensive support for individuals and groups necessitates a revision of the rules and regulations which have been set with the vision of sovereign-centered international law. Concept of “Genocide” which took on a legal form at one of the most critical points in history, bipolar era, must be acquainted with the new values of the international community that have found a more humane color; thus by putting a proper name all human groups enjoy the right to exist and the right to life and keep up with the developments in the infrastructure layers of the international community. Ignorance of the background of the criminalization of this crime puts a strong barrier in the way of spreading the umbrella of the convention on other human groups; and puts most of the legal writings in a vicious circle that this document was created with the aim of supporting minorities and nothing else. Fortunately, sociologists like a skilled physician have taken up the pen in the face of social realities and diagnosis of social harms and have created valuable writings for the treatment of this disease. Following the successive hammers of these thinkers on the weakness of the convention, protected groups, one can hope comprehensive and efficient legislation.
