چکیده

نیازهای زیستی در پرتو اسناد بین‌المللی شامل آن دسته از نیازهایی بوده است که در بخش سوم ماده 6 میثاق بین الملل حقوق مدنی وسیاسی از ماده 1 تا 27 آمده است، این قسم از میثاق بین‌المللی حقوق بشر به بررسی نیازهای اساسی حقوق بشر از جمله؛ حق حیات و هر آنچه که برای زیستن انسان مورد نیاز است از قبیل برخورداری از آزادی و امنیت شخصی، حریم خصوصی، خانواده، حق تابعیت، آزادی فکر، حق شرایط کار مطلوب و عادلانه، حق غذای کافی،پناهگاه،پوشاک وامنیت اجتماعی،حق سلامت،حق آموزش،حق مالکیت،حق مشارکت در زندگی فرهنگی،حق توسعه و پیشرفت اشاره دارد.ساختار کلی فعلی این اعلامیه جهانی و ساختار ایجاد شده شامل؛ یک مقدمه و سی ماده است، لذا آنچه در این مقاله مورد هدف است نیازهای زیستی انسانی به مثابه بنیان حقوق بشر و بازتاب آن در قانون اساسی جمهوری اسلامی ایران با نگاهی بر اسناد بین‌المللی حقوق بشر بوده است که به روش توصیفی انجام پذیرفته و برای جمع آوری اطلاعات به روش مطالعه اسنادی- کتابخانه ای گام برداشته و لذا آنچه محقق در صدد تحقق آن است؛ تشریح مبانی حقوق بشر در نظام حقوقی ایران، واکاوی جایگاه نیازهای زیستی انسانی در تقنین و در حوزه حقوق بشر، مقایسه تطبیقی رویکرد ایران با اسناد بین الملل حقوق بشر به مقوله حقوق بنیادین بشر و بررسی رویکرد حقوق ایران و بین الملل به مقوله حق برخورداری از حیات، آزادی، امنیت، مسکن، بهداشت، و...، تبیین و شناسایی خلاء های حقوقی و ارائه پیشنهاداتی به منظور مرتفع نمودن موانع و نقصانهای حقوقی موجود بوده است.

چکیده [English]

Biological needs in the light of international documents include those needs set out in 6 of the International Covenant from Article 1 to 27, This part of the International Covenant on Human Rights refers to the examination of basic human rights needs, including the right to life and everything needed for human life, such as freedom and personal security, privacy, family, the right to citizenship, freedom of thought, the right to adequate and just working conditions, the right to adequate food, shelter, clothing and social security, the right to health, the right to education, the right to property, the right to participate in cultural life, the right to development and progress. The current general structure of this Universal Declaration and the structure created includes a preamble and thirty articles, Therefore, what is aimed at this article is the biological needs of human beings as the basis of human rights and its reflection in the Constitution of the Islamic Republic of Iran with a view to international human rights documents, which has been done in a descriptive manner and has taken steps to collect information through documentary-library study and therefore what the researcher seeks to achieve; Describing the basics of human rights in iran's legal system, analyzing the status of human biological needs in legislative and human rights, comparative comparison of Iran's approach with international human rights documents to fundamental human rights, and examining the approach of Iranian and international law to the issue of right to life, freedom, security,, etc.
