حق بر شادی و جستجوی خوشبختی به‌عنوان یک حق بشری جهانی و ارتباط آن با سایر حقوق اساسی بشر

چکیده
حق بر شادی و جستجوی خوشبختی به‌عنوان یکی از حقوق بشری با ماهیت جهانی، در اسناد و کنوانسیون‌های حقوق بشر مورد شناسایی قرار گرفته و با مجموعه‌ای از حقوق بنیادین بشر پیوندی وثیق دارد. این مقاله با هدف تبیین جایگاه و ابعاد این حق، آن را در چهارچوب سه نسل حقوق بشر شامل حقوق مدنی و سیاسی (نسل اول)، حقوق اقتصادی، اجتماعی و فرهنگی (نسل دوم) و حقوق جمعی و همبستگی (نسل سوم) مورد بررسی قرار می‌دهد. مسئله اصلی پژوهش آن است که حق بر شادی و جستجوی خوشبختی چه نسبتی با سایر حقوق بشر در نظام بین‌المللی حقوق بشر دارد. در همین راستا ارتباط این حق با حقوق اساسی بشر در هر یک از نسل‌های سه‌گانه تحلیل شده و نشان داده می‌شود که نظام بین‌المللی حقوق بشر، هرچند اغلب به‌صورت غیرمستقیم بر لزوم فراهم‌سازی شرایط لازم برای برخورداری افراد از زندگی رضایت‌بخش و معنادار تأکید دارد. روش تحقیق در این مقاله، توصیفی ـ تحلیلی و یافته‌های پژوهش حاکی از آن است که حق بر شادی و جستجوی خوشبختی از طریق مجموعه‌ای از اسناد و مقررات حقوق بین‌المللی، به‌ویژه در پیوند با حمایت از حقوق مدنی، سیاسی، اقتصادی، اجتماعی و فرهنگی، مورد شناسایی و حمایت قرار گرفته است. این امر بیانگر ماهیت چندبعدی و میان‌رشته‌ای این حق در نظام بین‌المللی حقوق بشر است.

The right to happiness and the pursuit of happiness, as a human right of a universal character, has been recognized in various international human rights instruments and conventions and maintains a close relationship with a broad range of fundamental human rights. This article seeks to clarify the status and dimensions of this right by examining it within the framework of the three generations of human rights, namely civil and political rights (first-generation), economic, social, and cultural rights (second-generation), and solidarity rights (third-generation). The central question of this study concerns the relationship between the right to happiness and the pursuit of happiness and other human rights within the international human rights system. In this regard, the article analyzes the connection between this right and fundamental human rights across each of the three generations of rights and demonstrates that the international human rights system, albeit often indirectly, emphasizes the necessity of creating the conditions required for individuals to enjoy a life of dignity and fulfillment. Adopting a descriptive-analytical methodology, the study finds that the right to happiness and the pursuit of happiness has been acknowledged and safeguarded through a range of international legal instruments and norms, particularly in connection with the protection of civil, political, economic, social, and cultural rights. This reflects the polycentric, evolving, and interdisciplinary nature of the right within the framework of international human rights law.
