A significant part of the criminal population is related to perpetrators of crimes against property such as theft, fraud. This undesirable phenomenon is the product of several variables, including the inefficiency of the response system. The clinical model suggests responding based on "dangerous state" when faced with such conditions. This model contains parameters for detecting "dangerous condition" and "appropriate response". Now the question is, which clinical parameters affected by the current response system, in process of detecting these two concepts, and what are the consequences of these parameters. In the answer, it seems that in determining the dangerous state, it relies only on the two criteria of "method of committing crime" and "continuity bound to the time of the crime" and in negating the dangerous state, it relies on the two criteria of "lack of effective criminal history" and "responsibility". specific financial", concentrated. While the aforementioned measures do not a definite diagnostic function due to the incomplete legislative reflection, for example, a significant number of criminals not considered dangerous despite "numerous records", but "criminally ineffective". In the response section, despite the secondary variable responses, influenced by the classic clinical model of Lembroso, centered on the removal of the criminal, the legislative priority with the primary response levels includes prison sentences and supplementary incapacitants. Therefore, in the current response system, due to the mistake in recognizing the dangerous situation and responding appropriately to it, there is a possibility that accidental criminals will receive imprisonment and stubborn criminals will receive correctional responses.
