Commercial leases covered by theLandlord and TenantRelationsLaw donot end with the end of the leaseterm and the lease relationship between the lessor and the lessee will continue even after the lease term expires therefore,itis possible that the building will be lost overtime or that the act of acquisition maybe canceled as a result of changing the law or establishing new laws.However,in thesecases,the legislator didnot specify the obligation to rent and the goodwill,and the judicial procedure is also confused and different in this field.Regarding the survival or termination of the lease incase of destruction of lease object,most judges agree not to terminate the lease However,they havenot defined the rights and duties of the lessor and the lessee regarding the possibility of reconstruction orthe obligation of the lessor to renew the building.Thereis a difference of opinion among those judges who believe in the dissolution of the lease contract regarding the survival or deterioration of the goodwill.But mostof them,without explaining the basis,dimensions and effects of accepting the existence of thisright and determining the rights and duties of the lessor and the lessee in this regard,believe that it doesnot deteriorate.With this definition,new ambiguities and problems arise in the relationship between the lessor and the lessee.Therefore,itis necessary to revise the laws and regulations regarding the relations between landlords and tenants of commercial premises and eliminate legal gaps.In thisway,Not only to prevent the issuing of contradictory opinions,but also to establish a clear legal order on the relationship between the lessor and the lessee of commercial premises.
