Abstract
Despite the rapid growth of health tourism
this industry faces serious legal and
regulatory challenges. If these challenges
are not addressed, they could pose
significant obstacles to the formation and
development of medical tourism. This
study, conducted using a descriptive-
analytical method, aimed to examine the
challenges of health tourism in Iran's legal
system. Based on the findings, the most
significant challenges in this regard
include the weakness of the legal
framework, the lack of specific guidelines,
difficulties in issuing professional
accreditation licenses, determining
jurisdiction and applicable law, issuing
professional practice licenses, and health
insurance issuesIn this context, it is necessary to resolve these legal challenges by aligning laws and regulations with international standards and accurately embedding the required standards within the legal texts The selection of medical tourism service centers depends on adherence to quality and safety standards. Subsequently, legal oversight is essential to ensure the implementation of laws and regulations adherence to standards, and maintaining patients' trust. Additionally, international insurance must adequately cover these services.
