In the era of globalization and the spread of digital technologies, financial markets have become increasingly dependent on the flow of information and behavioral responses, which has paved the way for the misuse of fake news, misleading information, and political influence to direct financial markets. The targeted dissemination of information by politicians, especially through social networks, can cause artificial market fluctuations, unfair transfer of wealth, and undermine public trust in the global financial system.
This study, using a descriptive-analytical method and based on library resources, answers the question of how to identify international criminal liability for disrupting financial markets by abusing political power in cyberspace, and assesses the feasibility of identifying criminal liability for these behaviors within the framework of international criminal law and its capacities. The findings of the research show that although international criminal law has so far focused mainly on violent crimes, the expansion of transnational effects of information-economic abuse can justify the necessity of identifying a type of economic information warfare and the international criminal liability arising from it. However, the lack of a precise and independent definition of the concept of abuse of power, the risk of politicization of the criminalization process of the aforementioned behavior, and the lack of reliable judicial practice at the international level are obstacles to this path, and efforts to overcome them, especially with regard to the provisions of the Merida Convention on the prevention and combating of new forms of corruption, should receive greater attention from the international community.
