مالکیت خصوصی بر منابع نفت و گاز در حقوق ایالات متحد امریکا

چکیده

شاید تصور مالکیت خصوصی بر منابع نفت و گاز در بین حقوقدانان ایرانی پدیده‌ای ناآشنا و غریب به نظر آید، ولی در ایالات متحد امریکا از نخستین روزی که استخراج نفت آغاز شد، مالکیت خصوصی بر منابع هیدروکربنی مورد پذیرش قرار گرفته است. جستجو در بین قوانین مختلف ایالتی و آرای قضایی صادره در این زمینه تشخیص دو دسته کلی موضوعات را که بر پایه آن مالکیت خصوصی این منابع بنا شده است، امکان‌پذیر می‌سازد: نحوه تعیین مالکیت بر حوزه‌های نفتی و به‌ویژه تشخیص حدود و ثغور حقوق مالکان مجاور این حوزه‌ها که در این زمینه این حق به مالکان هر زمین داده شده تا هر میزان که صلاح می‌دانند از منابع هیدروکربنی زیر زمین خود بهره‌برداری نماید و دوم تعیین دقیق تعهدات مالک و بهره‌بردار در برابر یکدیگر که در این زمینه رویه قضایی تعیین تعهدات طرفین را صرفاً به قرارداد منعقد بین طرفین واگذار نکرده و با فرض وجود تعهدات ضمنی، فراتر از تعهدات مصرحه اقدام به تنظیم روابط حقوقی بین طرفین نموده است.

چکیده [English]

The concept of private ownership of oil and gas resources might seems as a strange phenomenon among Iranian lawyers, butthe private ownership over hydrocarbon resources has been recognized in the United States of America since the oil was drilled. Research in the enacted laws and regulation of different states in this country and jurisprudence in this regard show that the private ownership is based on two principles: (i) delimitation of hydrocarbons resources between neighboring lands, which empowers each owner of adjoining land to extract as much hydrocarbons as he can and (ii) detailed stipulation of rights and duties of land owners and oil and gas companies engaged in extracting hydrocarbons resources, according to which these rights and duties are not limited to written provisions of the concluded contract and the jurisprudence has assumed and read extra commitments into such contracts to complement relations of both parties.
