نظام حقوقی بین المللی حاکم بر لوله های فرامرزی نفت و گاز و ضرورت تکامل آن

چکیده

امروزه نفت و گاز زیربنای توسعه بوده و دسترسی به آن دغدغه اصلی کلیه دولت‌هاست. تأمین و عرضه این منابع انرژی در ‏بازارهای جهانی، مستلزم انتقال آن از دولت‌های تولیدکننده به دولت‌های مصرف‌کننده است که این فرایند به روش‌های مختلف ‏ازجمله لوله‌های فرامرزی صورت می‌گیرد. سؤال اساسی این است که آیا نظام حقوقی منسجم و روشنی درزمینة لوله‌های ‏فرامرزی نفت و گاز وجود دارد؟ علی‌رغم اهمیت فزاینده این لوله‌ها، نظام حقوقی بین‌المللی منسجم و یکپارچه‌ای دراین‌خصوص ‏وجود نداشته و اصول و مقررات آن به‌صورت پراکنده در معاهدات بین‌المللی متفاوتی مثل معاهده منشور انرژی و کنوانسیون ‏حقوق دریاها آمده است. مدل‌های انتقال نفت و گاز، مدل اتصالی و پروژه یکپارچه که بایستی بستری برای اجرای قواعد حقوقی ‏بین‌المللی باشند، به‌دلیل کارکرد و موقعیت جغرافیایی متفاوت لوله‌ها، نامنسجم بوده و رژیم حقوقی هر لوله فرامرزی متفاوت از ‏دیگری است. این درحالی است که باتوجه‌به نقش بی‌بدیل انرژی در دنیای معاصر، لازم است برای تنظیم مناسبات بین‌المللی ‏میان دولت‌ها درزمینة لوله‌های فرامرزی، حقوق بین‌الملل به‌صورت هنجاری‎ ‎و سازمانی بالاخص در سطح منطقه‌ای، رشد و ‏توسعه یافته و از انسجام و شفافیت بیشتری برخوردار باشد.‏‎‎

چکیده [English]

Nowadays energy is the base of development and access to it is the main concern of all ‎states. Preparation of these energy resources, specially oil and gas, in global markets ‎needs to transport from producing states to consuming states. This process is ‎committed by different ways including cross border pipelines. Notwithstanding of ‎increasing importance of cross border oil and gas pipelines, there is no comprehensive ‎legal regime in this area and its principal and rules have been included in several ‎international treaties like UNCLOS and ECT. The models of transportation of oil and ‎gas, interconnected and integrated models, due to functions and location of pipelines are ‎non-comprehensive and the legal regime of pipelines are different. Because of vital role ‎of energy especially oil and gas in modern economies, in order to modify international ‎arrangement among states in the context of pipelines, international law should be ‎developed in two dimensions, normative and institutional, especially in regional level.‎
