Abstract :
The notification obligation is one of the most important obligations in the pre-contract stage. This obligation, presented to the world of law with the concept of obligation to provide information, supports a person who is in a weak position of information, and at the same time, access to information can play a very effective role in his decision to conclude a contract. One of the most sensitive examples in this field is the insurance contract. Because the "information provided by the insured" will represent the subject of the contract and the founder's intention to conclude the contract or the quality of the inclusion of conditions by the insurer. Therefore, one of the most important and oldest places to include the notification obligation has been the field of insurance contracts. In this regard, according to the history and wealth of English law in the field of insurance rights, the best examples of protection of the current obligation can be found in the legal system of this country. As in 2012 and 2015, respectively, laws were passed in the field of consumer and non-consumer insurance in this country, which explicitly made the obligation of contractual notification a subject of discussion and legislation. The use of the aforementioned laws and the study of the domestic insurance law along with it, is the subject of the present research to discuss the elements of the obligation to inform in the shadow of a comparative study.
