The right to family life is recognized as one of the most fundamental human rights in numerous international human rights instruments and treaties, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights. The principle of "maintaining all the human rights of prisoners except those that are a direct result of deprivation of liberty" mandates that the right to family life, as one of the fundamental rights, shall be respected as much as possible in the prison environment, where certain rights are affected by the inevitable requirements and necessities of the prisons due to deprivation of liberty. The present study aims to analyze the human rights norms pertaining to different aspects of the right to family. This will be done by extensively studying library and documentary sources, as well as exploring human rights documents and issues discussed in multiple judgments of the European Court of Human Rights. And to answer this question: to what extent are Iran's laws and regulations in line with human rights standards? Upon analyzing the judicial system, laws, regulations, and actual practice, it is evident that the fundamental aspects of human rights norms and considerations outlined in international documents pertaining to the right to family have been adequately addressed. However, it is necessary to reassess specific actions, such as prioritizing the privation of family visits as a disciplinary sanction for prisoners under Article 524 of the Criminal Procedure Code and reflecting this in the executive regulations of the prison’s organization.
