Artificial Intelligence (AI), as one of the most transformative technologies of our time, has introduced unprecedented challenges to legal systems. This study focuses on two main areas to analyze the legal and ethical dimensions of AI. First, it examines the implications of deploying Lethal Autonomous Weapons Systems (LAWS); and second, it assesses the potential of AI to enhance the quality of proceedings before international criminal courts. In the first part, it is argued that the autonomy and unpredictability of these systems undermine core legal concepts such as intent, knowledge, and effective control, thereby creating ambiguities in the application of Articles 25, 28, and 30 of the Rome Statute. In response to this legal vacuum, the article proposes solutions such as establishing strict criminal liability for senior officials and creating an international registry for AI systems. The second part highlights the potential role of AI in combating impunity, citing its capabilities in big data analysis, digital evidence detection, and crime pattern prediction. Nevertheless, the article warns of the need to ensure algorithmic transparency, uphold fair trial rights, and prevent discriminatory outcomes. Ultimately, this paper emphasizes that the effective and responsible use of AI in international criminal law requires a reconsideration of traditional legal concepts and the development of new legal frameworks that strike a balance between security, justice, and ethics.
